Conditions of Use

By using the EmigrateShop website you agree to be bound by its conditions of use, legal notices, our Data Privacy Statement and all disclaimers, terms and conditions that appear elsewhere on the EmigrateShop website.

Payments

Payment of the delivery can be made by direct debit (only for German customers who have a German bank account), by cash on delivery (only for customers from D and A), by credit card, by PayPal or by SOFORT Überweisung (only for customers from D, A, NL, B, F, I, E).

By Credit Card

Customers paying with their credit card (MASTERCARD, VISA, AMEX, JBC, DINERS CLUB, EUROCARD) have to fill in their credit card number and the expiration date. By filling in these details, you confirm that you are the legal owner of this credit card. The invoice amount will be debited on your credit card statement in the name of Rundumschlag Management & Merchandising oHG (hereinafter referred to as „Rundumschlag oHG“). The payment will be debited DIRECTLY.

By direct debit

A customer needs to own a German bank account in order to take part in the automatic debit transfer system.
The customer authorises the Rundumschlag oHG to collect the amount due from his bank account. For this purpose you state your bank details during the order process and declare your acceptance by activating a check mark. Entering the data during the order process will make the DIRECT debit.

In case of dishonour or chargeback of a correctly made direct debit from our site, the Rundumschlag oHG reserves the right to charge the customer a fee amounting to 6.90 EUR for the costs of the chargeback. Please avoid inconveniences!
We are sending only one reminder! If no payment is made within the term set, we will assign our claim to a company entitled to collect the amount.

By Cash on Delivery (COD)

The advantage of Cash on Delivery (COD) is that it gives customers the ability to pay when they receive the package. But this shipping method is more expensive than paying by credit card or direct debit, since shippers charge for this service. COD shipments are only possible in Germany and Austria. Our COD fees are 2.90 EUR. For COD deliveries in Germany, an additional 2.00 EUR is paid directly to the shipper upon delivery. These 2.00 EUR are not part of our invoice.

By PayPal

Customers can also pay conveniently and securely using PayPal. All you need is a login for PayPal. If you select PayPal as your payment option, you will automatically be redirected to a secure payment page. This is where you can make your payment without giving us your account information.
Please note that if you cancel a purchase made using PayPal, the money will be credited back to your PayPal account. You can then transfer the money from your PayPal account to your linked bank account. The payment will be debited DIRECTLY.

By SOFORT Banking (Instant Bank Transfer)

SOFORT Banking is the direct payment method of SOFORT AG. You do not need to register with SOFORT AG, since you make a SOFORT transfer using your banking details. In other words, when you fill out the form on the website of SOFORT AG, you not only enter your account information, but your personal bank PIN and a valid TAN as well. SOFORT AG then activates an automatic remittance in real time from your bank account and in your name. Changing over to your bank’s website is no longer needed.

If you select the SOFORT payment option, you will automatically be directed to the payment form of SOFORT AG during the ordering process. We cannot see the information you enter in the payment form.

Please note that not all banks support SOFORT Banking, since the following access information is needed to make a SOFORT transfer:

  • The sort code of your bank branch
  • Your account number or login name
  • The access data you use to log in at your bank (direct banking number or account number, depending on your bank)
  • The PIN number you use at your bank
  • Your TAN, which was assigned to you by your bank

SOFORT Banking is available in the following countries: Germany, Austria, the Netherlands, Belgium, France, Italy, Spain.

Delivery terms and dates

Unless we expressly agree to a binding delivery date in writing, the delivery dates we give you are always non-binding. Regardless of whether the delivery date is binding or not, we are not responsible for delivery delays resulting from force majeure due to changes in the legal or official approval situation, the breakdown of machinery, strikes and/or problems with the procurement of materials - even if this arises at the supplier’s location. In these cases, the agreed delivery date is implicitly extended for the amount of time needed to remove the obstacle. We reserve the right to make partial deliveries; the customer must accept them.

We process orders Mondays through Fridays within 24 hours after you place your order. Added to this is the time the parcel service needs to deliver your order. Please note that we have no control over delivery dates.

Defective shipments

Make sure that you accept only undamaged parcels from the postal service; in case of doubt, open it in the presence of a postman. Never accept damaged parcel’s!, because of showing the will to take damaged goods with this behaviour. If there are some problems or discrepancies, please write down the name of the postman.

Information about the exercise of the right to cancel

Right to cancel

You have the right to cancel this contract within 14 days without giving any reason.

The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good.

To exercise the right to cancel, you must inform us (Rundumschlag Management & Merchandising oHG, c/o EmigrateShop, Hertzstr. 63B, 13158 Berlin, Germany, telephone +49 30 41 72 747 13 , fax +49 30 41 72 747 19, e-mail info@emigrateshop.eu) of your decision to cancel this contract by a clear statement (e.g. a letter sent by post, fax or e-mail). You may use the attached model cancellation form, but it is not obligatory.

To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.

Effects of cancellation

If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us).

We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you.

We will make the reimbursement without undue delay, and not later than-
(a) 14 days after the day we receive back from you any goods supplied, or
(b) (if earlier) 14 days after the day you provide evidence that you have returned the goods, or
(c) if there were no goods supplied, 14 days after the day on which we are informed about your decision to cancel this contract.

We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Prices

Special offers are only valid as long as they are in stock. We reserve the right to change the prices if necessary. Alterations and mistakes subjected.

Reservation of title

The delivered product remains the property of Emigrate Production GmbH until it is paid for in full. Our General Terms and Conditions apply exclusively to all orders. When you accept the product we have delivered, you acknowledge the General Terms and Conditions as exclusively binding. Any side agreements, contract changes and contractual commitments require our express written confirmation in order to be valid.

Redistribution of items for commercial purposes

You agree contractually to purchase the ordered items exclusively for private purposes. This agreement is in effect for all items offered through Rundumschlag oHG / EmigrateShop, and also applies especially to special offers. Any redistribution of items for commercial purposes or in a commercial manner is restricted by law. In particular it is prohibited to distribute items in a commercial or mercantile manner through sale to a third-party or through non-authorized commercial sellers, by means of internet auctions or by non-authorized online-shops. Rundumschlag oHG / EmigrateShop reserves any and all rights that may arise in relation to a breach of the preceding agreement. Furthermore, Rundumschlag oHG / EmigrateShop reserves the right, in the event of an infringement of the agreement by the buyer, to cancel all not yet delivered orders and/or to decline any future order.

The private, non-commercial sale of the purchased item is permitted without restriction.

Miscellaneous

These order conditions are valid for all orders. By sending your order, you accept these conditions. We are not able for the suitability of our products for a particular purpose. You have to inspect the products immediately after delivery. All delivered articles remain the property of Emigrate Production GmbH until they are paid completely. If one of the above mentioned stipulations become invalid all other stipulations will still be valid. All conditions and moreover all contracts of sale are subjected to German law.

  • All deliveries are subject to these terms of delivery.
  • We assure our goods to be free of manufacturing or material defects or errors. We are not responsible for any misuse of our articles for purposes intended by the customer. The customer is obliged to check the goods for defects immediately after delivery.
  • Special offers are only valid while supplies last.
  • All prices are in Euro/EUR and are subject to change. The sum total in your shopping cart as well as prices displayed on our help site are shown in Euro/EUR. This also applies for our terms of delivery. Changes in prices, errors and omissions expected.
  • The printing process can sometimes lead to slight color variations.
  • The delivered goods remain the property of Emigrate Production GmbH until fully paid for.
  • The information on this website is protected by copyright. Reprints, even extracts must be authorized by the publisher.
  • All image rights belong to the Emigrate Production GmbH. Any unauthorized use is not permitted.
  • These regulations - as well as any contract for sale based on these regulations - are subject to German law.
